It has been a tough year for landlords wanting to evict tenants with the CDC eviction moratorium. Beginning on October 1st, Colorado landlords have to adapt to new changes in lease requirements and the eviction process.


SB21-173 and HB21-1121 expand tenant rights and change the legal procedures for evictions. Colorado landlords should be aware of these new changes to successfully evict tenants, including new requirements before and during eviction proceedings, and after a writ of restitution is issued.


A landlord that fails to follow the new requirements can potentially be fined $50 for each violation, and face a civil action filed by tenants. Understanding the new requirements will help ensure landlords remain compliant, avoid fees and litigation, and successfully terminate tenancies and/or evict if necessary.

Annie Murphy is an attorney with Dufford Waldeck Law in Grand Junction, Colorado. She represents plaintiffs and defendants in construction and real estate negotiations and litigation. Annie specializes in landlord/tenant law and represents franchises and other commercial owners, property managers, and landlords in connection with the drafting or negotiation of their commercial or residential leases and property management agreements, also assisting clients with acquisitions. In the multifamily residential leasing context, she also reviews and drafts House or Community Rules and policies and procedures. She counsels and educates affordable housing clients on HUD rules, regulations, and recommendations and unique issues arising in housing.
