Advanced Fair Housing: The Perils & Pitfalls of Criminal Background Screening This webinar will explore some of the most common issues that have arisen from the 2016 guidance from HUD's general council concerning the use of criminal history screening in multifamily housing and the use of arrests in housing decisions.

We will discuss how to develop and administer criminal screening policies that will withstand a Fair Housing Act disparate impact challenge. We will concentrate on affordable housing requirements that must be enforced, as well as optional screening criteria that should be considered.

This session will address some of the issues that arise from applying appropriate look-back periods to the various types of crime involved in an applicant's criminal record, including the time after exit from incarceration. This session will describe the potential risks and benefits involved with each type of policy.

Some of the topics that we will cover include:

  • Backgrounds: sex offender, terrorist, and drug screening

  • What to consider when doing criminal screening

  • What to consider when doing rental history screening

  • Using arrest records in making decisions

  • Applicant or tenant requests for reasonable accommodations related to criminal activity
