Advanced Fair Housing: The Perils & Pitfalls of Criminal Background Screening

We will discuss how to develop and administer criminal screening policies that will withstand a Fair Housing Act disparate impact challenge. We will concentrate on affordable housing requirements that must be enforced, as well as optional screening criteria that should be considered.

This session will address some of the issues that arise from applying appropriate look-back periods to the various types of crime involved in an applicant's criminal record, including the time after exit from incarceration. This session will describe the potential risks and benefits involved with each type of policy.
